Episode Description: Jessica B. Harris may have been born and raised in New York City, but she has Tennessee roots through her father and has spent much of her life split between homes in the Northeast and the South – specifically New Orleans. For more than fifty years, she has been a college professor, a writer, and a lecturer, and her many books have earned her a reputation as an authority on food of the African Diaspora, as well as a lifetime achievement award from the James Beard Foundation. A few years back, Netflix adapted her book, High on the Hog: A Culinary Journey from Africa to America , into a 4 part docuseries. And I’m very proud to say that she’s a longtime contributor to Southern Living with a regular column called The Welcome Table. This episode was recorded in the Southern Living Birmingham studios, and Sid and Jessica talked about her mother’s signature mac and cheese, the cast-iron skillet she’d be sure to save if ever her house were on fire, and her dear friend, the late New Orleans chef Leah Chase. With certain exceptions, unfinished business “dies” on the Order Paper and must be started anew in a subsequent session. Bills which have not received Royal Assent before prorogation are “entirely terminated” and, in order to be proceeded with in the new session, must be reintroduced as if they had never existed.116 On occasion, however, bills are reinstated at the start of a new session at the same stage they had reached at the end of the previous session. This is accomplished either with the unanimous consent of the House117 or through the adoption of a motion to that effect, after notice and debate.118 The House has also adopted provisional amendments to the Standing Orders to carry over legislation to the next session following a prorogation. Since 2003, prorogation has had almost no practical effect on Private Members’ Business.120 As a result of this significant exception to the termination of business principle, the List for the Consideration of Private Members’ Business established at the beginning of a Parliament, all bills that originate in the House of Commons and all motions in the Order of Precedence, as well as those outside of it, continue from session to session.121 If consideration of an item at a certain stage had begun but had not been completed, the item is restored at the beginning of that stage, as if no debate had yet occurred. Private Members’ bills that were referred to a committee in the previous session are deemed referred back to the same committee. Private Members’ bills which have been read a third time and passed are sent again to the Senate.122 With dissolution, all business of the House is terminated. The Speaker, the Deputy Speaker and the members of the Board of Internal Economy continue in office for the acquittal of certain administrative duties until they are replaced in a new Parliament.143 For the purposes of certain allowances payable to them, Members of the House of Commons at the time of dissolution are deemed to remain so until the date of the general election.144 Members’ offices, both in Ottawa and in their constituencies, remain open in order to allow Members and their staff to provide services to constituents.145 As the office budget for Members is drawn from public funds, Members’ offices and staff may not be used for electoral purposes. All items on the Order Paper including government and private Members’ bills die.146 The government’s obligation to provide answers to written questions, to respond to petitions or to produce papers requested by the House also ends with dissolution.147 The government must wait until the new Parliament is in session before tabling any document that is required pursuant to an act, resolution or Standing Order. Committees cease to exist until the House reconstitutes them following the election. All orders of reference expire, and the Chairs and Vice-Chairs of all committees cease to hold office. The government is no longer required to provide responses to committee reports. The executive committees of interparliamentary associations carry over from one Parliament to another. However, as a general rule, the activities being organized by the associations are postponed during a dissolution. Since multilateral assemblies continue to meet, Canada’s representation is usually ensured by Senators.148 Once an election has been held and prior to the start of a new Parliament, both Senators and re-elected Members may participate. Official parliamentary exchange programs with other assemblies are also usually postponed. Ultimately, there "was no national emergency justifying the invocation of the Emergencies Act," he wrote. The Federal Court case was argued by two national groups, the Canadian Civil Liberties Association and the Canadian Constitution Foundation, and two people whose bank accounts were frozen. They argued Ottawa did not meet the legal threshold when it invoked the legislation, which had never been used before. The act gave law enforcement extraordinary powers to remove and arrest protesters and gave the government the power to freeze the finances of those connected to the protests. The temporary emergency powers also gave authorities the ability to commandeer tow trucks to remove protesters' vehicles from the streets of the capital. Under the Emergencies Act, a national emergency only exists if the situation "cannot be effectively dealt with under any other law of Canada." Further, a public order emergency can be declared only in response to "an emergency that arises from threats to the security of Canada that are so serious as to be a national emergency." The act defers to the Canadian Security Intelligence Service's definition of such threats — which includes serious violence against persons or property, espionage, foreign interference or an intent to overthrow the government by violence. "The potential for serious violence, or being unable to say that there was no potential for serious violence was, of course, a valid reason for concern," he wrote. "But in my view, it did not satisfy the test required to invoke the Act, particularly as there was no evidence of a similar 'hardened cell' elsewhere in the country, only speculation, and the situation at Coutts had been resolved without violence." Mosley's decision also examined one of the most controversial steps taken by the government in response to the protests — the freezing of participants' bank accounts. "I agree with the [the government] that the objective was pressing and substantial and that there was a rational connection between freezing the accounts and the objective, to stop funding the blockades. However, the measures were not minimally impairing," he wrote. The judge said the economic orders infringed on protesters' freedom of expression "as they were overbroad in their application to persons who wished to protest but were not engaged in activities likely to lead to a breach of the peace." He also concluded the economic orders violated protesters' Charter rights "by permitting unreasonable search and seizure of the financial information of designated persons and the freezing of their bank and credit card accounts." "And that's never a good situation." Caputo, along with Rob Moore, MP for Fundy Royal, Larry Brock, MP for Brantford-Brant and Langley-Aldergrove MP Tako van Popta signed off on the letter. NDP MP Randall Garrison from Esquimalt-Saanich-Sooke and the Bloq’s Rhéal Éloi Fortin form Riviere-du-Nord, who also sit on the committee, did not sign. The 11-member committee consists of five Liberal MPs, four Conservatives, one NDP and one Bloc Québécois member.
