Trial is a battle of perception and jurors pay very close attention to the behavior of the litigants, particularly the defendant. Behavioral consistency is highly correlated with honesty and truthfulness. This process begins in jury selection and continues through opening statements, testimony of all witnesses, and closing arguments.
